These Terms & Conditions govern access to and use of the website, forms, booking pages, and website design, hosting, and management services offered by ProjectWon, operated by ProjectWon LLC (“ProjectWon,” “we,” “us,” or “our”).
By using our website or services, you agree to these Terms. If you do not agree, do not use our website or services.

01What ProjectWon does
ProjectWon builds, hosts, and manages websites for service businesses in the trades. It is a managed service: we design and build the site, host it, keep it online, and make the changes you request. Clients do not build or maintain the site themselves.
ProjectWon is not a contractor, trade company, or emergency service provider. We do not perform HVAC, plumbing, electrical, roofing, or any other trade work. Any work performed by a business that uses our services is the responsibility of that business.
02Eligibility
You must be at least 18 years old and able to enter into a legally binding agreement to use our services. If you use our services on behalf of a business, you represent that you have authority to bind that business to these Terms.
03Access to your accounts
Building and managing your site may require access to accounts you control, including your domain registrar, DNS, hosting, email provider, analytics, or Google Business Profile. When you give us access or add us as a user, you authorize us to use that access only to build, host, manage, support, and secure your site.
You are responsible for keeping your own login credentials secure and for activity under your accounts. You may revoke our access at any time, but doing so may prevent us from performing the service you are paying for.
We may suspend or terminate access if we believe an account is being misused, used unlawfully, used in violation of these Terms, or used in a way that could harm ProjectWon, our clients, or others.
04Client responsibilities
If you are a client, you are responsible for:
- Providing accurate business information, including business name, phone number, hours, service areas, service descriptions, pricing or promotions you want published, license numbers, certifications, and insurance details;
- Owning or having the rights to every logo, photo, video, review, testimonial, and piece of text you give us to publish;
- Reviewing and approving your site before it goes live, and reviewing edits after they are made — you are responsible for the accuracy of what is published;
- Telling us when your hours, pricing, service area, licensing, or contact information changes;
- Complying with the advertising, licensing, disclosure, and trade rules that apply to your business in your state;
- Handling your own customer service, scheduling, service delivery, pricing, refunds, warranties, disputes, and trade-specific obligations.
05What the monthly plan includes
The monthly plan covers design and build of your site at the page count and scope agreed at onboarding, hosting, connection of your domain, an SSL certificate, and ongoing management and maintenance of the site while your account is active.
It also includes edits to existing pages — text, photos, hours, pricing, and promotions — at no additional cost, in a reasonable volume. See Section 06 for turnaround.
Anything beyond that scope is custom work: additional pages, new functionality, integrations with third-party tools, e-commerce, booking systems, applications, or work on properties we did not build. Custom work is quoted separately and billed in addition to the monthly fee. We quote it and you approve it in writing before work starts.
06Timelines
Our target is to have a new site live in about a week from the point we have your content, account access, and approvals. Edit requests to existing pages are typically completed within two business days of the request.
These are targets based on how we work, not guarantees. Timelines depend on how quickly you provide materials and approvals, the complexity of the request, and third parties outside our control, including domain registrars, DNS propagation, hosting providers, and platform reviews.
07Payment, billing, and cancellation
The service is $297 per month with no setup fee. An annual option is available at $2,970 per year. Additional pages and custom work are quoted separately and billed in addition to the plan fee.
Plans are month-to-month unless a written agreement states otherwise. By starting service, you authorize ProjectWon and our payment processor to charge the payment method you provide on a recurring basis — monthly or annually depending on your plan — until you cancel. Billing begins when we start work unless we agree otherwise in writing.
If a payment fails or an invoice goes unpaid, we may pause edit requests, suspend service, or take the site offline after notice to you. Service resumes once the balance is paid.
Cancellation
You may cancel by sending written notice to contact@projectwon.ai. Cancellation takes effect at the end of the current billing period. Fees already paid for the current period are not refunded, and prepaid annual fees are not refunded for unused months, unless required by law or stated in a separate written agreement.
When service ends, hosting and management end with it and the site is taken offline. Your domain and the materials you provided remain yours. The site itself remains ProjectWon property under Section 08, and any transfer of it is only by separate written agreement.
Price changes
We may change pricing or plan terms with at least 30 days’ written notice to active clients. Continued use of the service after a change takes effect means you accept the updated pricing.
08Ownership and intellectual property
What stays yours. Your domain name, business name, logo, trademarks, photos, videos, reviews, customer data, and any text or materials you provide remain yours. You grant us a license to use them for the purpose of building, hosting, managing, supporting, and maintaining your site, and for the portfolio use described below.
What stays ours. This is a managed service, not a purchase. The site build itself — including its code, templates, layouts, components, design system, structure, and configuration — along with our workflows, processes, and everything on projectwon.ai, remains the property of ProjectWon or its licensors. The monthly fee pays for the service, not a transfer of ownership. Any transfer of a site is only by separate written agreement.
Portfolio use. You allow us to show your site, business name, logo, and screenshots of your site as an example of our work in our marketing materials. Tell us in writing if you would rather we did not, and we will stop.
Third-party assets used in your site, such as fonts, icons, imagery, and libraries, are licensed for use on the site while it is managed by ProjectWon.
You may not copy, reproduce, resell, reverse engineer, modify, or create derivative works from ProjectWon materials, templates, or systems without our written permission.
09Content, accuracy, and approvals
We publish what you give us or approve. We do not independently verify licensing, insurance, certifications, pricing, service claims, or the authenticity of reviews and testimonials. That responsibility is yours.
Reviews and testimonials displayed on your site must be real and displayed in a way that complies with applicable law and the rules of the platform they came from.
We may decline to publish, or may remove, content we believe is unlawful, deceptive, infringing, or harmful. That includes guarantees of results, claims about licenses or certifications you do not hold, and misleading pricing.
10Website forms and your customers’ information
Client sites include a contact form that delivers submissions to an email address you designate. That information belongs to you. You are responsible for how you use it, including any follow-up marketing and any consent, opt-out, or do-not-contact obligations that apply.
We deliver the submission to you and keep the form working. We do not monitor, read, or respond to it. Checking and answering your inquiries is your responsibility.
11No guarantee of results
We do not guarantee any specific search ranking, traffic level, number of leads, phone calls, form submissions, booked jobs, sales, revenue, profit, reviews, conversion rate, or business outcome. Nothing on our website, in our proposals, or in any conversation should be understood as such a guarantee.
12Hosting, domains, and third-party services
We rely on third-party providers for hosting, domain and DNS services, content delivery, SSL certificates, email delivery, form handling, analytics, review platforms, and payment processing. We are not responsible for outages, delays, errors, data loss, security incidents, pricing changes, feature changes, or policy changes caused by those providers.
We aim to keep your site available and online, but we do not guarantee that it will always be available, uninterrupted, secure, or error-free. Sites may be briefly unavailable for maintenance, updates, provider outages, internet issues, attacks, or other events outside our control.
Unless we agree otherwise in writing, your domain name is registered in your name and renewing it is your responsibility. If a domain lapses, the site will go offline until it is restored.
13Use of AI tools
We use AI-assisted tools in our own workflow — in design, code, and copywriting — the same way a shop uses power tools. Everything published on your site is reviewed by us and approved by you before it goes live.
AI-generated output can be inaccurate or incomplete, which is why approval sits with you.
14Communications from ProjectWon
We may contact you by phone, text message, and email about your inquiry, a scheduled call, onboarding, your project, edit requests, support, billing, and account matters.
SMS terms and mobile messaging
By providing a phone number through a form or booking page on projectwon.ai, by texting or calling one of our numbers, or by signing up as a client, you agree that ProjectWon may contact you by phone call or text message about your inquiry, appointment, project, or account. Message and data rates may apply. Message frequency varies based on your inquiry and account activity.
Where we send marketing text messages, we send them only with legally required consent. Consent to receive marketing text messages is not a condition of purchase.
You may opt out at any time by replying “STOP” to any text message. Reply “HELP” for help. After you opt out, you may still receive non-marketing messages where allowed by law, such as messages about an active project, a scheduled call, billing, or account administration.
Text-message delivery depends on wireless carriers, messaging providers, registration and campaign approvals, number reputation, spam filtering, and device settings. We do not guarantee that every message will be delivered, received, or read.
We send service-related, onboarding, support, and billing emails, and, where permitted, marketing emails. Marketing emails include a way to unsubscribe. If you unsubscribe from marketing, we may still send non-marketing messages related to your active service, invoices, agreements, security, support, or legal obligations.
Call recording
Calls with ProjectWon may be recorded, transcribed, or summarized for quality, training, and recordkeeping where permitted by law. Where notice or consent is required, we will provide it at the start of the call. If you do not want a call recorded, tell us and we will not record it.
15Acceptable use
You agree not to use ProjectWon or a ProjectWon-built site to:
- Violate any law or regulation;
- Publish false, deceptive, or misleading claims about your business, licensing, certifications, pricing, availability, or services;
- Publish content you do not have the rights to use;
- Send spam, fraudulent messages, or unlawful marketing;
- Harass, abuse, threaten, or harm others;
- Upload malware, viruses, or harmful code;
- Interfere with or disrupt the services;
- Attempt to access systems, accounts, or data without permission;
- Operate illegal, unsafe, or deceptive business practices.
16Confidentiality
If we receive confidential business information from you, we will use reasonable efforts to protect it and use it only to provide, support, improve, and secure the services, or as otherwise allowed by agreement or law.
You agree not to disclose non-public information about ProjectWon, including custom quotes, technical systems, templates, workflows, or business processes, unless we allow it in writing.
17Disclaimers
ProjectWon is provided on an “as is” and “as available” basis. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, and error-free operation.
We do not guarantee leads, calls, appointments, booked jobs, sales, revenue, profit, search rankings, traffic, reviews, or any other business outcome.
We do not guarantee that a site will always be online, that every form submission will be delivered, that every email will reach an inbox, or that third-party systems will always work.
We do not provide legal, compliance, tax, accounting, insurance, or professional trade advice, and we do not guarantee that your use of the services makes your business compliant with any law, regulation, licensing requirement, advertising rule, or platform policy. Get your own professional advice.
18Limitation of liability
To the fullest extent allowed by law, ProjectWon and its owners, employees, contractors, partners, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, service delays, customer disputes, or reputational harm.
To the fullest extent allowed by law, our total liability for any claim related to the website or services will not exceed the amount you paid to ProjectWon for the services giving rise to the claim during the three months before the event that caused the claim, or $100 if no paid services were provided.
19Indemnification
You agree to defend, indemnify, and hold harmless ProjectWon and its owners, employees, contractors, partners, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney’s fees, arising from your use of the services, the content and materials you provide or approve for publication, your violation of these Terms, your violation of law, claims about the services your business performs, your business operations, or your use of customer information collected through your site.
20Suspension and termination
We may suspend or terminate your access to the website or services if you violate these Terms, fail to pay required fees, create risk for ProjectWon or others, or use the services in a way we believe is unlawful, abusive, deceptive, or harmful.
You may cancel as described in Section 07, subject to any payment obligations, notice requirements, or terms stated in your proposal, invoice, or written agreement.
Data retention after cancellation
After termination or cancellation, we may retain client records, project files, communication records, billing records, consent records, logs, and backups for a reasonable period as needed for legal compliance, billing, tax, accounting, dispute resolution, fraud prevention, security, audit, or legitimate business purposes.
You may request export or deletion of certain data by contacting us at contact@projectwon.ai. Export or deletion may be limited by technical restrictions, third-party platform limitations, legal obligations, backup systems, active disputes, unpaid invoices, or the rights of other parties.
We are not responsible for data that remains stored in third-party systems you control, including your domain registrar, email provider, review platforms, or other connected accounts.
21Separate agreements and order terms
If a client signs or accepts a separate proposal, invoice, order form, statement of work, or service agreement with ProjectWon LLC, that agreement controls over these Terms for the specific services, pricing, payment terms, cancellation terms, scope, and obligations it covers.
These Terms apply generally to the website and services, but they do not override a signed or otherwise accepted written agreement between ProjectWon LLC and a client unless that agreement says otherwise.
22Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes will be handled in the state or federal courts located in Texas, unless a separate written agreement states otherwise.
23Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “last updated” date. Continued use of the website or services after changes are posted means you accept the updated Terms.
